Dear Mr. Hayes:
On April 10, 2026 I sent letters to both the Randolph and Chatham County Boards of Elections requesting documents in support of my intended challenge to their decision not to include me on the November ballot for NC House District 54. In the case of Randolph County, I received a mere handful of documents that are almost certainly insufficiently responsive to my request; and for Chatham County, despite several demands for records through their retained counsel, I am still awaiting documents — more than two months after my demand letter. As the deadline for printing ballots is approaching fast, I believe I can no longer delay my request for a hearing to challenge the results.
Unfortunately, § 163-122(d) — that a “person whose petition has been cancelled… may request a hearing… in accordance with Article 11B of this Chapter” — does not provide sufficient guidance for proceeding. Article 11B deals solely with challenging a candidate’s inclusion on the ballot for constitutional or statutory grounds. It emphatically does not spell out a clean path for a candidate whose petition was reduced below the statutory threshold by signature rejection.

District 54 voters deserve a contested race. This hearing request is how that fight was put on the State Board’s calendar.
