Subject: Follow Up to Request for Hearing to Challenge the Denial of Ballot Inclusion — District 54 (dated June 13, 2026)
Dear Mr. Hayes:
On June 13, 2026, I sent by registered mail, and subsequently by email, my request for a hearing to challenge my denial to be on the ballot for District 54, attached thereto as Exhibit A. Despite that the most relevant portion of N.C.G.S. § 163-122 requires a hearing date be set within five (5) days of request, it has now been over 25 days without response other than confirmation of receipt on June 26, 2026 (at the latest) — see Exhibit B. This delay, coupled with the almost three months (and counting) taken to fulfill my record request with Chatham and Randolph County Boards of Elections (despite the extraordinary step of hiring outside counsel to assist) — see Exhibit C — makes it appear that election officials are either derelict in their duties or are engaging in a systematic campaign to delay and frustrate efforts to give the roughly 68,000 registered voters of District 54 a choice this November.
This July 11 filing asks the Board to act — including by issuing a ruling in lieu of hearing if a timely hearing still has not been set — so ballot production does not moot the voters’ interest in a contested race.
